Oversight Board of The Former Lakeport Redevelopment Agency



The California Supreme Court, in a decision issued on December 29, 2011 (California Redevelopment Association et al. v. Ana Matosantos et al), upheld a bill passed by the California Legislature,  ABX1 26, that abolishes redevelopment agencies, and invalidated as unconstitutional a companion bill, ABX1 26, that would have permitted redevelopment agencies to continue operation if their sponsoring jurisdiction agreed to make certain payments to the State for the benefit of schools. As a result, the Redevelopment Agency of the City of Santa Rosa along with all redevelopment agencies in California were dissolved on February 1, 2012.

Following dissolution of the Redevelopment Agency of the City of Lakeport (“Agency”), the City elected to become the successor agency to the Agency by Resolution No. 2441, dated January 10, 2012 (the “Successor Agency”).  Pursuant to Health and Safety Code Section 34173(b), the Successor Agency is now a separate legal entity from the City.  One of the responsibilities of the Successor Agency is to prepare a Recognized Obligation Payment Schedule (“ROPS”), which sets forth the nature, amount, and source(s) of payment of all “enforceable obligations” of the Agency (as defined by law) to be paid by the Successor Agency.

Pursuant to AB 1484, passed by the State Legislature on June 27, 2012, a new schedule for submittal of a ROPS for periods subsequent to the period ending December 31, 2012 was established. Under AB 1484 a Successor Agency is required to submit the approved ROPS for the period July 1, 2019 through June 30, 2020 to the County of Lake Auditor­ Controller, the California State Controller, and the State of California Department of Finance and posted on the City’s website by February 1, 2019.

Oversight Board
Effective January 1, 2019 a County-wide Oversight Board has been established to oversee the activity of the Lakeport, Clearlake and Lake County Successor Agencies.
